PRICE A BUILDING TERMS AND CONDITIONS
  1. Initial engineering deposit on a credit card is to secure quoted building price. Balance of engineering deposit, by check or bank wire, must be received before engineering begins. Anchor bolt layout (and permit drawings if applicable) will be mailed approximately 2 to 3 weeks after receipt of the balance of the deposit due. Deposits are non-refundable.Balance of building to be paid one week before delivery by wire transfer or cashiers check ONLY.
  2. Unless specifically noted, Manufacturer and Seller exclude, but are not limited to, the following: erection, foundation design, concrete, imbeds, anchor bolts, overhead doors, unloading, storage, field painting and taxes.
  3. LIMITED WARRANTY: Manufacturer makes the following limited express warranties to the owner if the goods are constructed in compliance with manufacturer’s erection drawings and in workmanlike manner. These warranties shall be voided by any procedural or other changes in construction, modification or engineering addition not approved by the manufacturer, by improper site selection, site preparation errors or failure to comply with manufacturer’s instructions or warnings regarding payment, delivery, storage or handling. The limited warranty applies only to products manufactured by this manufacturer. There are no warranties except those contained herein. Manufacturer has not authorized any person or company to assume, on behalf of the Manufacturer, any liability in connection with the materials supplied not to increase the scope of the warranty. The goods, when properly constructed, shall meet the Manufacturer’s specifications. All manufacturer’s materials are free of defects in workmanship or materials and shall be warranted as such for a period of one year from the date of delivery by or pick-up from the Manufacturer. Quality shall conform to the requirements and specifications of the Manufacturer as stated herein. Manufacturer will replace or repair at manufacturer’s discretion any defective material furnished within one year upon presentation of satisfactory evidence of such defect, but no claims for direct or consequential damage will be allowed.
  4. Unless specifically noted by the Buyer within 3 days of receipt of plans, plans prepared by Manufacturer shall be deemed the correct interpretation of the contract and work to be performed. If Buyer's order is on approval status, failure to return signed approval letter to move building into fabrication within one week of receipt of approval drawings will result in a $250 late charge to be added to Buyer's contract price.
  5. The place of fabrication, the routing and method of shipment, the place or purchase price, of all or any part of the material to be included herein shall be at the sole discretion of the Seller.
  6. Manufacturer and Seller shall not be liable nor held liable for delays in performance in whole or in part of this contract resulting in whole or in part from any cause, beyond the control of manufacturer and Seller, including but not limited to, acts of God, fire, earthquake, flood, windstorm, or strikes, lockouts or other differences with employees, war, riot, embargoes, delays losses or damages in transportation, or shortage of cars, trucks, fuel, labor or the material. In case of the happening of any such cause of delay, the time of completion shall be extended accordingly.
  7. Manufacturer is not responsible for any fieldwork of any kind under any circumstances performed on any material furnished under this contract without prior authorization in writing from Manufacturer.
  8. Buyer is responsible for ordering and erecting a structure that, when complete, complies with state and local building codes and zoning, and which will be sufficient to withstand local environmental conditions. Manufacturer and seller make no claim as to the adequacy of the loads ordered.
  9. Florida residents are responsible (in addition to #8 of these terms) for verifying if the manufacturer has to be a Florida Approved Fabricator and/or if the roof and wall panels have to be NOA certified. Any additional costs incurred for these items not verified when contract is signed are the customer’s responsibility.
  10. Delivery is community freight. Buyer agrees that failure to accept delivery or pick-up, when scheduled shall constitute breach of contract and shall pay a minimum $2,000.00 charge, plus freight and monthly storage charges equal to 5% of the contract price, accruing monthly until the material is resold or the buyer accepts delivery.
  11. Final Payment; Buyer agrees that failure to make their Final Payment within one week of their delivery or pick up date, will constitute breach of contract & shall pay a minimum of $2,000.00 charge, plus freight and monthly storage charge equal to 5% of the contract price, accruing monthly until the material is resold or the buyer accepts delivery.
  12. Upon acceptance hereof, this order and such acceptance shall be deemed to be contract embodying all oral and written understanding and agreements between the Buyer and Seller relative to the sale. The Seller shall not be bound by any condition, definition, representation or warranty other than as expressly set forth herein. The contract shall be interpreted in accordance with the laws of the State of Colorado.
  13. The terms of payment, unless otherwise noted, shall be as follows: 35% at time of contract acceptance or $2,000.00, whichever is greater. Balance of contract to be paid within one to two weeks before building delivery by wire transfer or cashiers check ONLY. (To including all applicable sales taxes).
  14. Any claims of shortages by Buyer must be made to Seller within five (5) business days after delivery, or such claims are waived by Buyer. Within ten days of a written request from Seller, Buyer shall provide documentation supporting the actual costs associated with any claims, or those claims shall be waived.
  15. Buyer is responsible for any additional charges incurred by improper off-loading of materials.
  16. Any approval job or job placed on hold, and held longer than 30 days, will be subject to any price increase in materials and/or freight charges.
